1. Eligibility: The Vuelta
a Espana Grand Tour Sweepstakes (the
“Promotion”) is open only to legal residents of the 50 United States and
the District of Columbia, who are 18 years of age or older and located in the
U.S. who have internet access at the time of entry. Employees, contractors,
directors and officers of Universal Sports (“Sponsor”), Site Systems (“Judging
Agency”) and their respective parents, subsidiaries and affiliated companies,
distributors, licensees and the advertising, fulfillment, judging and promotion
agencies involved in the development and administration of this Promotion
(collectively, “Promotion Parties”), and their immediate family members
(parent, child, sibling and spouse of each) and those living in the same
households of each are not eligible. Void elsewhere and where prohibited by law.
2. Promotion Period: The
Promotion begins at 12:00 a.m. Pacific Time ("PT") on August 27, 2010
and ends at 11:59 p.m. PT on September 18, 2010 (the "Promotion
Period").
3. How to Enter:
a. Registration Entries.
During the promotion period go to www.universalsports.com/vueltasweepstakes
(“Website”) to locate the official entry form. Follow the on-screen directions,
complete all required registration fields and submit to receive on entry into
the Sweepstakes Drawing. Entrants must complete all required information
(“Entry Information”). LIMIT ONE (1) REGISTRATION ENTRY PER PERSON/E-MAIL
ADDRESS.
b. Selection Entries.
During the Promotion Period you may visit the Website and be offered the chance
to select the overall race winner ("Race Winner") and/or one or more
stage winners ("Stage Winners") of the 2010 Vuelta a Espana (the “Race”).
Each day you make one or more selections (each a "Selection Entry") you
will receive an entry into the Final Drawing for a Grand or First Prize;
provided, however, that selection of the Race Winner must be made prior to
11:59PM PT on September 7, 2010, or the start of the 11th Stage, whichever
occurs first, but you may change your selection for the Race Winner up until
such time. Your selection for Stage Winners must be received by 11:59PM PT of
the day before the start of the applicable stage. LIMIT ONE (1) SELECTION ENTRY
PER PERSON/E-MAIL ADDRESS PER DAY.
c. Stage Entries. At
the end of each stage of the Race, if you correctly selected the Stage Winner for
that stage (as per the final determination of the Vuelta a Espana officials) you
will receive one (1) entry in the drawing for that stage’s prize and (10)
entries in the Final Sweepstakes Drawing ("Stage Entries").
d. Race Winner Entries.
At the end of the Tour, if you correctly selected the Race Winner (as per the
final determination of the Vuelta a Espana officials), you will receive fifty
(50) entries into the Final Sweepstakes Drawing ("Race Winner
Entries").
4. Random Drawings:
On or about September 29, 2010, the Judging Agency will conduct the following random
drawings:
a. Final Sweepstakes
Drawing. The Judging Agency will conduct a random drawing for the Grand
Prize and the First Prize from among all eligible Registration Entries, Selection
Entries and Race Winner Entries received during the Promotion Period.
b. Stage Drawings.
The Judging Agency will conduct a random drawing for each stage of the race (21
total Stage Drawings) for each stage’s prize from among all eligible Stage
Entries received for each stage of the Race during the Promotion Period.
5. Prizes, Approximate Retail Value (“ARV”)
& Odds: One (1) Grand Prize: Trip for two (2) to the culminating city
of the Vuelta a Espana 2011. Trip includes round trip coach airfare for two
from the major airport nearest winner’s residence (as determined by Sponsor) to
Madrid, Spain and hotel accommodations (double occupancy) for up to 6 days / 5 maximum
value of $3,500), and $1000 paid by check. (ARV: $4,500). Location of
culminating city is subject to change. One (1) First Prize: Giant 2011
Giant Defy 1 awarded in the form of a gift certificate redeemable at a
Giant-approved local bicycle store. ARV ($1,300).
Twenty One (21) Stage Prizes (one per stage): One (1) Official Vuelta 2010
Jersey (ARV: $75). Total ARV of all prizes is $7,375. Actual value of Grand
Prize will depend on airfare fluctuations and point of departure. Grand Prize
winner and travel companion must have a valid passport and be able to travel on
dates listed or as designated by Sponsor or prize will be forfeited in its
entirety and an alternate winner may be selected, at Sponsor’s option. Dates of trip, location, travel arrangements and accommodations
are at Sponsor's sole discretion, and are subject to availability and change.
All other expenses not specifically mentioned herein, including, but not
limited to, additional meals, gas, insurance, tolls, beverages, activities,
incidental hotel expenses, taxes and/or gratuities are the sole responsibility
of the winner and his/her travel companion. Winner and travel companion must
travel on the same itinerary, and must comply with all security requirements.
Winner’s travel companion must be the age of majority in his or her state of
residence and must sign and return a liability/publicity release as a condition
of travel. If any event is cancelled after travel is booked, only travel
portion of prize will be awarded and no compensation will be given for event
portion of the prize. Any difference between stated value and actual value
will not be awarded. Actual travel dates are based on the final schedule of
the event. No substitution, cash redemption or transfer of prizes is permitted
except at Sponsor’s sole discretion. If a prize, or any portion thereof, cannot
be awarded for any reason, Sponsor reserves the right to substitute a prize of
equal or greater value. All federal, state and local taxes, and all other costs
associated with acceptance or use of the prizes, are the sole responsibility of
the winner. Arrangements for delivery of prizes will be performed after winner
validation. LIMIT ONE PRIZE PER PERSON/EMAIL ADDRESS/HOUSEHOLD. Odds of winning any prize depend on the number
of entries received. At the Sponsor’s discretion, unclaimed prizes may not be
awarded.
6. General Rules: All federal, state and local laws apply. Winners
will be notified by email, mail or telephone. Potential winners (or
potential winners' parent or legal guardian if potential winner is a minor) may be required to sign and return an Affidavit
of Eligibility and Release of Liability and a Publicity Release within ten (10)
days of attempted delivery or prize will be forfeited. The return of any
prize/prize notification as undeliverable or failure to respond to notices or return
any documents in a timely manner, as determined by the Judging Agency, may
result in disqualification and an alternate winner may be chosen. By
participating, participants agree to release, discharge and hold harmless
Promotion Parties from and against any and all liability or damages associated
with this Promotion or acceptance, use or misuse of any prize received in this
Promotion. Promotion Parties are not responsible for any typographical or
other error in the printing of the offer or administration of the Promotion.
Acceptance of prize constitutes permission for the Sponsor and its agencies to
use winners’ names and likenesses for purposes of advertising and publicity
without further compensation, unless prohibited by law. By participating in
this Promotion, participants agree to be bound by the Official Rules and
decisions of the independent Judging Agency, which shall be final in all
matters relating to the Promotion. Promotion Parties are not responsible for lost,
late, misdirected, stolen, illegible, inaccurate, damaged, incomplete,
non-delivered or postage-due mail; or for printing,
distribution or production errors or for technical, hardware, software, or
telephone malfunctions of any kind, lost or unavailable network connections, or
failed, incorrect, incomplete, inaccurate, garbled or delayed electronic
communications caused by the user or by any of the equipment or programming
associated with or utilized in this Promotion, or by any human, or other error,
which may occur in this Promotion. If, in the Judging Agency's sole opinion,
there is any suspected or actual evidence of tampering with any portion of the
Promotion or if technical difficulties compromise the integrity of the
Promotion, the Judging Agency reserves the right to void suspect entries and/or
modify the Promotion and/or conduct a random drawing to award the prizes using
all known eligible non-suspect entries received. In the event of a
dispute regarding the identity of the person submitting an entry, entries will
be declared made by the person's name submitted at time of entry. Sponsor reserves the right to disqualify any
individual who tampers with the Promotion or Website or acts in a disruptive
manner. This Promotion is offered only in the United States and is governed by
the laws of the State of California.
By entering, entrants irrevocably consent to the sole and exclusive
jurisdiction of the courts of the State of California located in the county of Los Angeles for any action, suit or proceeding arising
out of or relating to this Promotion.
Sponsor reserves the right to share Entry Information with affiliates,
partners and Contest Entities. Entry Information and other information made
available or otherwise provided by you may be used in various ways, including
but not limited to, understanding user behavior and patterns, for internal
discussion, making decisions about advertising placement and sponsors,
improving the quality, functionality and user experience, providing third party
offers to you through email and any related materials. If
you do not want us to share your Entry Information with our affiliated
companies for their marketing purposes, you may select not to opt in on the
entry form.
7. Waiver: By participating in this
Promotion, participant waives all rights to claim punitive, incidental and
consequential damages, attorneys’ fees or any damages other than actual
out-of-pocket costs incurred to participate.
8. Winners’ List: To receive a copy of
the Winners’ List for this Promotion (available after 10/6/2010, mail a
self-addressed, stamped #10 envelope to be received by 10/31/2010 to: Winner's
List, Vuelta a Espana Grand Tour Sweepstakes, P.O. Box 5442, Culver City, CA, 90231-5442.
