1. Eligibility: The Cricut® 5th Anniversary Promotion (the "Promotion") is open only to legal residents of the 50 United States and the District of Columbia, Canada (excluding Quebec) and Great Britain, who are 21 years of age or older. Employees, contractors, directors and officers of Provo Craft and Novelty, Inc. ("Sponsor" or "Promoter"), Site Systems ("Judging Agency") and their respective parents, subsidiaries and affiliated companies, distributors, licensees and the advertising, fulfillment, judging and promotion agencies involved in the development and administration of this Promotion (collectively, "Promotion Parties"), and their immediate family members (parent, child, sibling and spouse of each) and those living in the same households of each are not eligible. Void elsewhere and where prohibited by law.
2. Promotion Period: The Promotion begins at 12:00 a.m. Pacific Daylight Time ("PDT") (i.e. 8:00 a.m. UK time)) on September 1, 2011 and ends at 11:59 p.m. PDT (i.e. 7:59 a.m. 1/1/12 UK time) on December 31, 2011 (the "Promotion Period").
3. How to Enter: Online Entry: During the Promotion Period, go to www.cricut5th.com, www.cricut5th.com/michaels, www.cricut5th.com/acmoore, www.cricut5th.com/hobbylobby, www.cricut5th.com/hsn, www.cricut5th.com/JoAnn or www.facebook.com/OfficialCricut (collectively, "Websites") and click on the link to locate the official entry form. For entry on Facebook, you will need to "like" Cricut and then accept the Cricut® 5th Anniversary Promotion application. To enter, you can use a product code or serial number from the package of an eligible or participating Cricut® product purchased within the Promotion Period. One unique code required per entry. Once you have completed the required information, follow the on-screen instructions to play the instant win game. After you have played the instant win game, you will automatically receive one entry into the Grand Prize Drawing. If you receive a winning message, you are a potential winner of the prize indicated, subject to verification by the Judging Agency. Follow the on-screen instructions to claim your prize. You are not a winner until your prize claim is validated and you receive official written notification from the Judging Agency.
To obtain an entry code without making a purchase, mail a hand-printed, self-addressed, stamped envelope to: Cricut 5th Anniversary Promo, Attn: No Purchase Necessary, PO Box 98, Kimberly, WI 54136. VT residents omit return postage. Requests must be postmarked by 12/31/11 and received by 1/7/12. You will receive a unique promotion code in the mail within approximately two weeks. Entry codes received via mail must be entered online by January 21, 2012. Promotion Parties assume no responsibility for lost, late, misdirected, stolen, illegible, inaccurate, damaged, incomplete, non-delivered or postage-due mail; or for failure or unavailability of electronic equipment, communications or Internet connections; or other errors, failures or malfunctions of any kind.
LIMIT FIVE (5) ONLINE ENTRIES PER PERSON/E-MAIL ADDRESS PER WEEK AND MAXIMUM OF FORTY (40) ONLINE ENTRIES FOR THE DURATION OF THE PROMOTION. Entries must not be sent in through agents or third parties. Incomplete entries will be disqualified and will not be counted.
4. Winner Selection:
a. Instant Win Selection: Instant Win prizes will be randomly seeded throughout the Promotion Period. If you are the first to play the game at or after a randomly determined winning time you will be a potential instant winner of the prize indicated.
b. Grand Prize Drawing: On or about January 30, 2012, the Judging Agency will conduct a random drawing from among all eligible Online entries received during the entire Promotion Period. The winners will be notified on or around January 31, 2012 by mail, email or phone. If any winner is not able, for any reason, to accept a prize, or cannot be contacted within 10 days of the initial notification date, the Promoter reserves the right to award the prize to another entrant.
5. Prizes, Approximate Retail Value ("ARV") & Odds:
a. GRAND PRIZES: A total of thirteen Grand Prizes will be awarded (one to each winner), grouped into the following categories:
Grand Prize No. 1 (seven prizes): Caribbean cruise for two, round-trip coach air transportation for two from a major airport near winner's residence (as determined by Sponsor) to Houston, Texas, pre-cruise hotel accommodation for 1 night (one standard room, double occupancy), Ground transfers to/from airport and hotel and cruise departure location, inside stateroom with a maximum of two persons aboard the Mariner of the Seas cruise ship for seven (7) nights; All shipboard meals for winner and travel companion; Government taxes and fees (as defined in the Royal Caribbean brochure) for winner and travel companion. Winner's guest must be 18 years of age or older, unless the winner is the parent/legal guardian of the guest. (ARV: $4,600). For the seven Grand Prize No. 1 trip prizes, one prize will be allocated to entrants at each of the Hobby Lobby, Michaels, AC Moore, JoAnn and HSN microsites within cricut.com. Grand Prize No. 2 (three prizes): Cartridge Pack (includes 100 Cricut® cartridges) (ARV: $6,000);
Grand Prize No. 3 (three prizes): Craft Room Makeover, awarded in the form of crafting tools and storage solutions, valued at $5,000. An expert chosen by Sponsor will visit winner's home to determine what crafting tools and storage solutions would be appropriate. HOWEVER, in the event a Grand Prize No. 3 winner resides in Canada or the Great Britain, winner will receive a check in the amount of $5,000 instead. (ARV: $5,000).
b. INSTANT WIN PRIZES: Twenty (20) Cricut Imagine™ Machine. (ARV: $500), Twenty (20) Cricut Cake® Machine (ARV: $500), Ten (10) Cricut Expression® 2: 5th Anniversary Edition Machine (ARV: $350). Total ARV of all prizes is $267,200. All values stated in U.S. Dollars. Cricut® Rewards Points and Cricut.com Credits must be used by December 31, 2012. Must have an existing account or open a Cricut® account to receive Cricut.com Credits and Cricut® Reward Points prizes. There is no cost in obtaining an account. If prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute a prize of equal or greater value. Except for winners from Great Britain, all federal, state and local taxes, and all other costs associated with acceptance or use of the prize, are the sole responsibility of the winner. Arrangements for delivery of prize will be performed after winner validation. LIMIT ONE (1) INSTANT WIN PRIZE PER PERSON/EMAIL ADDRESS AND ONE (1) GRAND PRIZE PER PERSON/EMAIL ADDRESS/HOUSEHOLD. Odds of winning any prize depend on the number of entries received. In the event a potential winner is a resident of Canada, potential winner will be required to correctly answer a time-limited mathematical skill testing question in order to receive a prize. Winners will be notified by email, mail or telephone. Unclaimed prizes will not be awarded.
6. Additional Conditions for the Grand Prize Winners: Prize must be taken on 1 April (outbound) until 7 April 2012 (return). Travel prize winner must be able to travel on the dates specified or prize will be forfeited in its entirety and an alternate winner may be selected, at Sponsor's sole option. Dates of trip, location, travel arrangements and accommodations are at Sponsor's sole discretion, and are subject to availability and change. Any expense not specifically mentioned herein, including, but not limited to, additional meals, gas, parking fees, insurance, travel insurance, tolls, beverages, activities, incidental hotel expenses, taxes and/or gratuities are the sole responsibility of winner. Winner must comply with all security requirements. Winner must have all necessary identification and/or travel documents (e.g., a valid passport, visa) required for travel. Actual value of prizes including travel will depend on point of departure and airfare fluctuations. Any difference between stated value and actual value will not be awarded.
7. General Rules: All federal, state, provincial and local laws apply. Potential winners may be required to sign and return a Declaration/Affidavit of Eligibility and Release of Liability and a Publicity Release (or a Winner's Confirmation Form in the case of winners from Great Britain) within ten (10) days of attempted delivery or prize will be forfeited. The return of any prize/prize notification as undeliverable or failure to return any documents in a timely manner may result in disqualification and an alternate winner may be chosen at Sponsor's sole discretion. Acceptance of prize constitutes permission for the Sponsor and its agencies to use winners' names and likenesses for purposes of advertising and publicity without further compensation, unless prohibited by law.
8. By participating, participants agree to release, discharge and hold harmless Promotion Parties and Facebook from and against any and all liability or damages associated with this Promotion or acceptance, use or misuse of any prize received in this Promotion. Promotion Parties are not responsible for any typographical or other error in the printing of the offer or administration of the Promotion.
9. To the extent that English law is applied to the Promotion or any dispute arising in relation thereto, this Section 9 shall apply: So far as is permitted by law, the Promoter and its associated companies and agents exclude responsibility and all liabilities arising from:
a. any postponement or cancellation of the Promotion, and
b. any changes to, supply of (including, without limitation, prizes which do not reach the intended recipient), or use of the prize, and
c. any act or default of any third party supplier which are beyond the Promoter's reasonable control. Nothing in these terms and conditions shall limit any party's liability for (i) death or personal injury arising out of such party's negligence, or (ii) for fraud.
10. Promotion Parties are not responsible for lost, late, misdirected, stolen, illegible, inaccurate, damaged, incomplete, non-delivered or postage-due mail; or for printing, distribution or production errors or for technical, hardware, software, or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Promotion, or by any human, or other error, which may occur in this Promotion.
11. If, in the Judging Agency's sole opinion, there is any suspected or actual evidence of tampering with any portion of the Promotion or if technical difficulties or other errors compromise the integrity of the Promotion, the Judging Agency reserves the right to void suspect entries and/or modify and/or terminate the Promotion and/or conduct a random drawing to award the prizes using all known eligible non-suspect entries received. In the event of a dispute regarding the identity of the person submitting an entry, entries will be declared made by the person's name submitted at time of entry. Sponsor reserves the right to disqualify any individual who tampers with the Promotion or Website or Facebook App or acts in a disruptive manner.
12. This Promotion is offered only in the United States, Canada and Great Britain and is governed by the laws of the State of Utah. By entering, entrants irrevocably consent to the sole and exclusive jurisdiction of the courts of the State of Utah located in the county of Salt Lake County for any action, suit or proceeding arising out of or relating to this Promotion.
13. Personal Data: The Promoter will use each winner's, and each entrant's, personal details for the purpose of administering this Promotion. 14. Waiver: By participating in this Promotion, participant waives all rights to claim punitive, incidental and consequential damages, attorneys' fees or any damages other than actual out-of-pocket costs incurred to participate.
