(1) Description of
Sweepstakes – California Giant Berry
Farms (the “Sponsor”) is offering the Sweet Lineup Sweepstakes (the
“Promotion”) and will award prizes via a random selection from eligible
entrants. The Promotion begins at 12:00:01 AM Pacific Time (“PT”) on April 1,
2009 and ends at 11:59:59 PM PT on May 31, 2009, (“Promotion Period”). The
Promotion is intended for participation only in the United States and shall be
construed according to, and governed exclusively by United States law. Do not
participate in the Promotion if you are not physically located in the United
States at time of entry. By participating in the Promotion, each entrant
unconditionally accepts and agrees to comply with and abide by these Official
Rules and the decisions of the Sponsor, which shall be final and binding in all
respects. By participating in the Promotion, participants agree to release,
discharge and hold harmless Promotion Entities (defined below), their
respective parents, affiliates, subsidiaries, divisions, retailers, agencies
and their respective officers, directors, employees and agents, from any and
all damages whether direct or indirect, which may be due to or arise out of
participation in the Promotion or any portion thereof, or the acceptance,
use/misuse or possession of prizes.
(2) Eligibility - The Promotion is open only to legal residents of the
50 United States residing in the 50 United States and the District of Columbia
(excluding Puerto Rico and all other US territories) who are 18 years of age or
older at the time of Promotion registration. Employees, officers and directors
of California Giant Berry Farms, Major League Baseball Players Alumni, Rawlings
Group, their respective parents, affiliates, subsidiaries, divisions,
advertising, promotional, fulfillment and marketing agencies, their immediate
families (parent, child, sibling & spouse) and persons living in the same
households as such individuals (whether related or not), (collectively
“Promotion Entities”) are not eligible to participate in the Promotion. Void in
Puerto Rico, all other US territories and where prohibited by law, rule or
regulation. All federal, state and local laws and regulations apply.
(3) How to Enter – On-line: Visit www.sweetlineup.com and complete the registration form with your first and last name, e-mail address, street address, city, state, zip code, phone number including area code, your date of birth and the answer to one (1) shopping question. You will have the option to “opt in” to receive subsequent electronic communication from the Sponsor and/or the Promotion Entities. Opting to receive further information is not a requirement for entry in the Sweepstakes nor does it increase your chances of winning. Limit one (1) entry per person per e-mail address per day. By Mail: Hand print your first name, last name, street address, city, state, zip code, home phone number including area code, your date of birth and your e-mail address on a 3” x 5” card and mail in a hand printed outer envelope to: Sweet Lineup Sweepstakes, PO Box 12487, Scottsdale, AZ 85267-2487. Mailed entries must be postmarked no later than June 1, 2009 and received no later than June 8, 2009. Limit, one entry per envelope and one entry per person per e-mail address per day. Limit, one prize per household.
Entries will be deemed made by the authorized account holder of the e-mail
address submitted at time of entry. The authorized account holder is defined as
the natural person who is assigned an e-mail address by an Internet access
provider, online service provider or other organization that is responsible for
assigning e-mail addresses or the domain associated with the submitted e-mail
address. A potential winner may be required to provide Sponsor with
satisfactory proof that he/she is the authorized account holder of the e-mail
address associated with the potentially winning entry. Entries generated by a
script, macro or other automated means will be disqualified. Multiple entrants
are not permitted to share the same e-mail address. Any attempt by any entrant
to obtain more than the stated number of entries by using multiple/different/duplicitous
e-mail addresses, the use of a sweepstakes service, the use of multiple
identities, registrations and logins, or any other methods will void that
entrant's entries and that entrant may be disqualified. Entries that are
incomplete, contain irregular or invalid information, or are corrupted are void
and will not be accepted. Information collected from an entrant is used
only for the purpose of the prize drawing and to notify winners, and will not
be re-used, sold or shared in any manner by Promotion Entities or any third
parties unless entrant has elected to receive additional information and
promotional material from the Sponsor and/or Promotion Entities. By entering
the Promotion, you agree to all of the terms and conditions of Sponsor’s Privacy
Policy, which is available at http://www.calgiant.com/privacy.asp.
(4) Prizes Available – One (1) Grand Prize – A private baseball clinic for up to two-hundred (200) children hosted by up to eight (8) Major League Baseball Players Alumni Association ballplayers, (“Celebrity Baseball Clinic”) Approximate Retail Value (“ARV”) $15,000. The Celebrity Baseball Clinic is a one-day event conducted in the hometown of the verified winner and is open to children between the ages of 6 and 18. The Celebrity Baseball Clinic must be conducted within one (1) year of prize award and held on a mutually agreed upon date between the Major League Baseball Players Alumni Association and the verified winner. The date of the Celebrity Baseball Clinic must be scheduled a minimum of three (3) months in advance of the actual clinic date. In case of inclement weather, clinic cannot be re-scheduled for a future date. Clinic will take place rain or shine. Parents or legal guardians of children participating in the Celebrity Baseball Clinic must execute a permission/release for the clinic prior to participation. The verified winner has the option of accepting the Celebrity Baseball Clinic prize or having the Sponsor donate the prize to a local school or youth oriented charity of his/her choice. One (1) First Prize – Rawlings® custom baseball glove and Rawlings® equipment bag, ARV $450. One (1) Second Prize – Rawlings® wood baseball bat personalized with winner’s name and Rawlings® equipment bag, ARV $250. One (1) Third Prize – Rawlings® baseball jacket and Rawlings® equipment bag, ARV $75. There are a total of four (4) prizes with an overall approximate value of $15,775. The odds of winning depend upon the total number of eligible entries received.
No prize recipient shall be permitted to replace his/her designated prize with another prize or item or redeem his/her prize for cash. Promotion entities reserve the right, exercisable at any time in their sole discretion, to substitute a prize of equal or greater value. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by the Sponsor. Any costs associated with prize acceptance and use not specified herein as being provided, is the winner’s sole responsibility. Unclaimed prizes will not be awarded.
(5) Prize Awarding - Winners will be selected in a random drawing from
all eligible entries conducted on or about June 15, 2009. Potential winners
will be contacted within five (5) business days of the drawing by phone and/or
e-mail (“Prize Notification”). Winner will be required to complete and return
an Affidavit of Eligibility and a
Liability/Publicity Release (unless prohibited by law), (“Prize Affidavit”).
The Prize Affidavit must be returned within ten (10) days of Sponsor’s
provision of these documents. Potential winners will also be required to send a copy of their passport,
driver’s license, birth certificate or other appropriate documentation
(acceptable to Sponsors) as proof of age and residency. Non-compliance with any
of these requirements will result in disqualification, in which case an
alternate winner will be chosen. Return of Prize Notification and/or the
Affidavit/Release as undeliverable will result in disqualification and an
alternate winner will be selected.
Entrants grant Sponsor the right to use and publish winner's proper name and
State of residence online in connection with the Promotion. Acceptance of a
prize constitutes permission for Sponsor and its affiliates to use winner's
name and likeness solely for advertising and promotional purposes as Sponsor so
determines without notice or further compensation, except where prohibited by
law. All federal, state, local, and other taxes on prizes are the sole
responsibility of the applicable winner.
(6) General - All decisions of the Sponsor in any matter relating to
this Promotion shall be binding and final. Sponsor is not responsible for
technical failures of any kind, including but not limited to the malfunctioning
of any computer, cable, network, hardware, software, or web site. Sponsor
is not responsible for lost, interrupted or unavailable network server or other
connections, miscommunications, failed telephone or computer or telephone
transmissions or technical failure, jumbled, scrambled or misdirected
transmissions, late, lost, misdirected or postage-due mail or for incorrect or
inaccurate entry information, howsoever caused, or other error of any kind
whether human, mechanical or electronic. Entrants found tampering with or
abusing any, aspect of this Promotion, as solely determined by the judges, will
be disqualified. If disqualified for any of the above abuses, Sponsor reserves
the right to terminate entrant's eligibility to participate in the Promotion.
Any attempt by any person to deliberately undermine the legitimate operation of
the Promotion may be in violation of criminal and civil law, and, should such
an attempt be made, Sponsor reserves the right to seek damages from any such
person to the fullest extent permitted by law. Sponsor’s failure to enforce any
term of these Official Rules shall not constitute a waiver of that provision.
Sponsor reserves the right to terminate, cancel, suspend and/or modify the
Promotion if any fraud, virus or other technical problem corrupts the
administration, security, or proper play of the Promotion, as determined by
Sponsor in its sole discretion. In such event, Sponsor reserves the right
to award the prizes at random from among the eligible entries received up to
the time of the impairment.
(7) Winners List - To receive the list of winners of prizes, send a self-addressed stamped envelope for receipt by June 8, 2009 to: Sweet Lineup Sweepstakes Winners List, PO Box 12055, Scottsdale, AZ 85267-2055. (WA and VT residents may omit return postage.)
